1. Agreement to Terms

By accessing or using the Smart AI Solutions website (smartaisolutions.co.za) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, users, and clients of our services.

2. Services Description

Smart AI Solutions provides AI development and automation services, including but not limited to:

• AI Developer Rental (dedicated AI developers for your projects)
• AI Chatbots and Virtual Assistants
• Process Automation and Workflow Optimisation
• Predictive Analytics and Business Intelligence
• CRM and Sales Automation
• WhatsApp Business Automation
• AI Team Enablement and Training
• Custom AI Integration Services

3. Engagement and Payment

All service engagements begin with a free consultation. Upon agreement:

• A custom proposal will be provided outlining scope, timeline, and investment
• Payment terms will be agreed upon before work commences
• We accept EFT (Electronic Funds Transfer), credit card, and debit orders
• All prices are quoted in South African Rand (ZAR) unless otherwise stated
• Monthly subscription services are billed in advance
• Custom project work may require a deposit before commencement

4. Cancellation and Refunds

AI Developer Rental plans can be upgraded, downgraded, or cancelled with 30 days written notice. There are no long-term contracts unless specifically requested. Project-based work that has already commenced is subject to payment for work completed. Refunds for prepaid services will be processed on a pro-rata basis for unused portions.

5. Intellectual Property

All custom AI solutions, code, and deliverables created specifically for your project become your property upon full payment, unless otherwise agreed in writing. Smart AI Solutions retains ownership of pre-existing tools, frameworks, and methodologies used in delivering services. We reserve the right to use anonymised case studies and aggregate data for marketing purposes.

6. Confidentiality

We treat all client information, business data, and project details as confidential. Non-disclosure agreements (NDAs) can be arranged upon request. Our team members are bound by confidentiality obligations. We will not share your business information with third parties without your explicit consent, except as required by law.

7. Data Protection

We comply with the Protection of Personal Information Act (POPIA) of South Africa. All data processing activities are conducted in accordance with our Privacy Policy. We implement appropriate security measures to protect your data and will notify you of any data breaches as required by POPIA.

8. Service Level and Availability

We strive to provide reliable, high-quality services. Business hours are Monday to Friday, 8:00 AM to 6:00 PM, and Saturday, 9:00 AM to 2:00 PM (SAST). Emergency support is available 24/7 for enterprise clients. We do not guarantee uninterrupted availability and may schedule maintenance as needed with advance notice.

9. Limitation of Liability

Smart AI Solutions shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim. We are not responsible for outcomes resulting from misuse of delivered AI solutions or failure to follow implementation guidelines.

10. Website Use

When using our website, you agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorised access to any part of the website
• Copy, reproduce, or redistribute website content without permission
• Interfere with the proper working of the website
• Use automated systems to access the website excessively

11. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of the Western Cape, South Africa.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website and services after changes constitutes acceptance of the new terms.
